These terms govern your use of lumoshospitality.com (the "site"). By using the site, you agree to them. If you do not agree, please do not use the site.

Who we are

This site is operated by Lumos Hospitality, LLC, a Kentucky limited liability company ("Lumos Hospitality", "we", "us", and "our"). We are a hospitality management and development consulting company. We manage boutique hotels and wedding venues for independent, third-party owners, and we provide development consulting.

These terms cover your use of the site itself, reading our pages and contacting us by email or phone. They do not cover any management or consulting engagement, which is addressed separately below.

Informational purposes only, no advice, no guaranteed results

The site describes how we work and gives you a way to start a conversation with us. It is general information, not advice and not a promise.

• Nothing on the site is legal, tax, financial, or investment advice. For decisions about your property or your business, rely on your own qualified professionals.
• Nothing on the site guarantees any result. We make no promise of any particular revenue, occupancy, or income for any property. Where the site describes our services or our approach, that description is not a guarantee of any outcome.
• Any estimate is an estimate. If we share a projection or an estimated figure, it is a good-faith estimate based on information available at the time. Actual results depend on factors outside our control, including market conditions, seasonality, the property itself, and applicable regulations, and will vary.
• Nothing on the site is an offer. Using the site does not commit us to manage or consult on any property, or to any particular pricing or terms.

Using the site does not create a management or consulting relationship

Reading the site or contacting us by email or phone does not create any management, consulting, agency, employment, or other professional relationship between you and us.

We begin a management or consulting engagement only under a separate written agreement signed by both parties. Until that agreement is signed, we have no obligation to you and you have none to us beyond these terms.

Who may use the site

You must be at least 18 years old and able to enter into a binding agreement. If you contact us about a property, you confirm that you own it or are authorized to act on the owner's behalf.

Information you give us

When you email or call us, you give us information such as your name, contact details, and anything else you choose to share. By doing so, you confirm the information is accurate and that you have the right to share it, and you agree we may contact you about your inquiry by email or phone. How we handle that information is described in our privacy policy.

Acceptable use

Please use the site lawfully. You agree not to:

• scrape, harvest, or use automated tools to collect data from the site;
• disrupt or overload the site, or try to gain unauthorized access to it or its systems;
• use the site for any unlawful, infringing, or fraudulent purpose; or
• impersonate anyone or misrepresent who you are or who you are affiliated with.

Our content

The site's content, including its text, design, the Lumos Hospitality name and brand, and its imagery, is owned by or licensed to us and protected by law. We give you permission to view the site for your own personal, non-commercial use. You may not copy, reuse, redistribute, or sell any of the content without our written permission.

Third-party links

The site may link to services or resources run by others. Those services have their own terms and privacy policies, and we are not responsible for them. A link to another site is not an endorsement of it.

The site is provided "as is"

We work to keep the site accurate and available, but we provide it "as is" and "as available." We do not warrant that it will be error-free, uninterrupted, or secure, or that its content is complete or current. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent Kentucky law allows, Lumos Hospitality, LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site. Our total liability for any claim relating to the site will not exceed one hundred dollars ($100).

Nothing in these terms limits any liability that Kentucky law does not allow to be limited or excluded.

Indemnity

You agree to indemnify and hold us harmless from any claim arising from your misuse of the site or your violation of these terms.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules.

The state and federal courts located in Jefferson County, Kentucky have exclusive jurisdiction over any dispute relating to the site or these terms, and you consent to that jurisdiction and venue. To the extent the law allows, you and we each waive any right to a jury trial in such a dispute, and agree that any dispute will be brought only on an individual basis, not as part of a class or representative action.

General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a part of these terms right away, we do not give up our right to do so later. These terms are the entire agreement between you and us about your use of the site.

Changes to these terms

We may update these terms from time to time. The "last updated" date above shows when they last changed. Changes take effect when we post them, and continuing to use the site means you accept the updated terms.
